1.1. Data: means any information relating to an identified or identifiable individual, i.e. an individual who can be identified, directly or indirectly, in particular by reference to an identifier, such as a name, an identification number, location data, an online identifier, or to one or more factors specific to his or her identity.
1.2 Data controller: EQUIRODI, a simplified joint stock company with a single shareholder, with capital of €5,000, registered with the LONS-LE-SAUNIER Trade and Companies Register under number 504 811 373, whose registered office is located at 3, rue de Scey 39100 DOLE (hereinafter referred to as "EQUIRODI").
1.3. Equirodi Network: all internet platforms published by EQUIRODI.
1.4. Services: all the services offered by EQUIRODI, the terms and conditions of which are defined in the General Terms and Conditions of Use applicable to the service (EQUIRODI Classifieds GTC, EQUIRODI Market GTC, Equirodi Sites GTC).
1.5. User: users of the Equirodi Network and Services.
2.1. When a User registers on one or more of the EQUIRODI Network platforms, enters and sends contact forms, places an Equirodi Market order, posts an advertisement, and more generally uses the Services, EQUIRODI collects and processes certain Data concerning natural persons, including first and last name, postal address, email address, telephone number, year of birth, IP address, login and password, bank details, information relating to browsing and interactions with the Services (pages consulted, search history, saved searches, forms, etc.).
2.2. The User agrees to the processing of his/her Data by EQUIRODI in accordance with current legislation, in particular the General Data Protection Regulation (hereinafter "GDPR").
3.1. The Data collected is used solely for the purposes of implementing the Services, as defined in the applicable General Terms and Conditions of Use and/or the applicable special terms and conditions, and to enable the improvement of services to meet the needs of Users. The legal basis is therefore the contract that the User has accepted by validating the GTCs.
3.2. Only the Data necessary for each specific purpose of processing set out below is processed, namely:
(a) to enable the User to create and update his/her personal account and accesses,
(b) to enable the User to create, publish, modify and manage advertisements,
(c) allow the User to post and publish comments and opinions,
(d) to respond to requests from the User and to send him/her any communication useful for the use, operation and improvement of the Services,
(e) facilitate interaction between Users, in particular through EQUIRODI's messaging system,
(f) compile general statistics on traffic on the EQUIRODI network platforms,
(g) conduct User satisfaction surveys and studies,
(h) evaluate and improve the quality of Services, and
(g) to bill the User.
3.3. Data may also be used for marketing and promotional purposes by EQUIRODI and partner companies (newsletters and personalised commercial offers), subject to the User's consent. The User may modify his/her preferences at any time in the "Preferences" section of "My Account".
4. Recipients of Personal Data
4.1. Data may be communicated:
(a) to other Users in order to facilitate interaction between sellers and buyers within the framework of the advertisement service (telephone numbers, email address), as soon as a relationship is established between them on the Network,
(b) EQUIRODI's commercial partners, subject to the User's consent,
(c) EQUIRODI's IT service providers, including ALTEO, 2 mail des Cerclades, 95031 Cergy, France, as part of its hosting services for EQUIRODI websites,
(d) administrative and legal authorities,
(e) online payment service providers PayPal, Cyberplus Paiement - Systempay (Banque Populaire) and MangoPay providing, on behalf of EQUIRODI, a service for managing commercial transactions by bank card managed on its secure servers.
4.2. Recipients are not authorised to share or sell Data to third parties.
4.3. In the case of a purchase on the Equirodi Market platform from a professional Seller, the Seller is jointly responsible with EQUIRODI for processing the data of the buyers listed below:
Collecting and transmitting data to the Seller
Managing Buyers' accounts
Monitoring the purchasing process and supporting Buyers
Hosting
Requests to exercise rights
Requests to exercise rights must be made by Buyers to EQUIRODI, which will forward them to the Seller. The Sellers have undertaken to comply with the RGPD security measures and not to transmit the data to third parties. For processing carried out by the Seller outside the Platform, it is the Seller's responsibility to inform the Buyer and to ensure that it has an adequate legal basis for implementing this processing.
4.4. If data is to be transferred to recipients outside the EU, EQUIRODI shall ensure that the safeguards set out in Chapter V of the GDPR are in place before the transfer takes place.
5.1. Data is kept by EQUIRODI for the duration of the validity of the personal account and for 5 years from the date of the last contact with EQUIRODI, subject to the needs of archiving the Data, in particular for purposes of proof.
5.2. Documents and accounting records are kept for 10 years as proof of accounting.
5.3. Contractual data is kept for the legal retention period for commercial contracts.
6.1. Right of access
The User has the right to obtain confirmation as to whether or not personal data concerning him or her is being processed and, where such data is being processed, the right to access said personal data as well as information on the processing carried out, pursuant to Article 15 of the RGPD.
6.2. Right of rectification
The User also has the right to obtain the rectification of personal data concerning him/her when it is inaccurate.
6.3. Right to erasure
The User also has the right to obtain the deletion of personal data concerning him/her when: they are no longer necessary with regard to the purposes for which they were collected, he/she objects to the processing in application of article 21 of the RGPD, he/she is able to demonstrate that these personal data are the subject of unlawful processing, the data collected concern a minor.
6.4. Right to limit processing
The User may obtain that the data controller limits the processing, for example by suspending it, when: a dispute arises as to the accuracy of the data processed, a dispute arises as to the lawfulness of the processing, the processing is no longer necessary for the data controller, but the data is still necessary for the establishment, exercise or defence of legal claims, the User has objected to the processing pursuant to Article 21(1) of the GDPR; but there is a dispute as to whether the legitimate grounds pursued by the data controller prevail over those of the User.
6.5. Right to data portability
Where processing is based on consent or on the preparation or performance of a contract, or carried out using automated processes, the User has the right to receive the data he or she has provided to the data controller, in a structured, commonly used and machine-readable format, and to transmit this data to another data controller.
6.6. Right to object
The User also has the following rights under the conditions defined in article 21 of the RGPD: the right to obtain, for reasons relating to his/her particular situation, that EQUIRODI no longer processes personal data concerning him/her in certain cases (article 21.1. of the RGPD); the right to object to the processing of personal data concerning him/her for canvassing purposes (right to object to canvassing - article 21.2. of the RGPD).
The exercise by the User of the right to object to the processing of his/her Data does not prevent the legitimate processing of his/her Data for the establishment, exercise or defence of EQUIRODI's legal rights.
6.7. Right to withdraw consent
The User has the right to withdraw his consent to the processing of his Data at any time when such processing is based on said consent, without affecting the lawfulness of the processing carried out prior to said withdrawal.
6.8. Directives relating to the retention, deletion and communication of personal data after death
Finally, the User has the right to define, modify and revoke at any time directives relating to the conservation, deletion and communication of his/her personal data after his/her death. These directives may be general or specific. The data controller may only be the custodian of specific directives concerning the data it processes. General directives may be collected and stored by a trusted digital third party certified by the CNIL. The User also has the right to designate a third party to whom the data concerning the User may be communicated after his/her death, by informing this third party of his/her approach and of the fact that data enabling him/her to be unambiguously identified will be transmitted to the data controller and to communicate this Data Protection Policy to him/her.
6.9. These rights may be exercised upon written request to EQUIRODI, 3, rue de Scey 39100 DOLE (France) or by email contact@equirodi.com, accompanied by a copy of any official document proving identity. EQUIRODI will have one (1) month from receipt of this request to respond, except in the case of abuse or where the deadline has been extended in accordance with the RGPD.
7.1. EQUIRODI shall use its best efforts to implement all physical, technical, organisational, electronic and administrative security measures necessary to protect Data (firewall system, physical and electronic access control, 24/7 surveillance, attack and intrusion detection system, pseudonymisation, Data encryption, etc.), in accordance with the RGPD.
7.2. The Data is stored on ALTEO's secure servers.
7.3. EQUIRODI employees are bound by confidentiality when processing Data.
8.1. The User may include a link in his advert to a video of his own published on YouTube. EQUIRODI uses the YouTube API for this purpose.
8.2. The video must comply with EQUIRODI's Terms and Conditions as well as YouTube's Terms of Use which can be found here: https://www.youtube.com/static?template=terms&gl=EN.
8.3. Furthermore, as this service requires a Google account, the User confirms that he/she has read Google's privacy policy: https://policies.google.com/privacy?hl=en
9.1. Any complaint by the User concerning the processing of his/her Data by EQUIRODI must first be sent in writing to EQUIRODI - 3, rue de Scey 39100 DOLE (France), or by email: contact@equirodi.com.
9.2. The User may lodge a complaint with the Commission Nationale de l'Informatique et des Libertés (CNIL) or with the supervisory authority of the European Union Member State in which the User is ordinarily resident, in accordance with the provisions of the RGPD.
1.1. Internet sites published by EQUIRODI (hereinafter the "Sites") use cookies, i.e. messages stored by the User's Internet browser in the form of text files which send information (pages consulted, date and time of consultation, etc.) back to Internet servers each time the browser needs to access a page on the server.
1.2 These cookies enable EQUIRODI to make it easier for the User to navigate the website, to compile statistics and to adapt the advertising offered on EQUIRODI websites.
1.3 These cookies are not used to personally identify a User but to keep a history of his activities and preferences that he chooses himself through his Internet browser. The User can easily manage them by choosing which cookies to save or delete.
2.1. Measuring site performance (analysis cookies)
2.1.1. EQUIRODI uses cookies to help improve the performance of its Sites in order to provide a better experience for its Users.
2.1.2. EQUIRODI also uses cookies to track the number of visits. No personally identifiable data (such as your name or email address) is collected during this process.
2.2. Helping EQUIRODI provide its services
Some cookies are necessary to ensure that the Sites published by EQUIRODI function properly. For example, Users may be asked to enter their login details. Cookies ensure that the information entered by the User is memorised throughout the session.
2.3. Personalising advertising outside the Sites published by EQUIRODI
EQUIRODI uses cookies to enable it to memorise Users' consultations and to personalise the information sent to them on the Sites published by EQUIRODI and outside the Sites.
2.4. Helping to share information through social media
Through its Sites, EQUIRODI offers a feature that allows users to share opinions, announcements and any type of content on social networks.
2.5. Advertising
Advertising agencies and their partners may also set cookies on Users' computers or mobile phones. These cookies may be used to track the frequency and content of advertising displayed based, for example, on the User's behaviour.
3.1. Users can manage cookies directly by going to the management settings of their Internet browser.
